Service Agreement Contract

This Service Agreement ("Agreement") is made between:

Live Wedding Painter Sydney
ABN: 52855445276
("Artist")

And the Client
("Client")

Effective Date: From Client Google Form Submission,

1. PROMISES OF THE ARTIST

The Artist agrees to provide the following services as part of their business, Live Wedding Painter Sydney:

  • Attend the Client's wedding, painting at the reception/celebrations, and providing the completed painting as the final product.

  • Cover travel within a 70 km radius from Sutherland Shire to the wedding venue.

  • Dedicate between 4-20 hours of work on the painting.

  • Ensure safe and secure delivery of the painting.

  • Supply all necessary materials and equipment for the painting.

  • Ensure all tax obligations are met.

  • The artwork will be a 16x20 artistic interpretation of the couple, painted in acrylic.

  • The painting style will reflect the artistic skill displayed in the Artist’s portfolio.

  • Cover any damages that may occur during delivery.

2. LIMITATIONS OF LIABILITY

The Artist shall not be liable for:

  • Copyright issues related to photos taken at the event that feature other businesses' work or the venue's settings.

  • Consent of guests appearing in photos/videos; the Artist acknowledges that permission to publish may not be given in some cases.

  • Interference with the photographer's contract or other vendors while taking photos or sharing content on social media.

  • Missing any specific moments that the Client requests to be captured.

  • Interfering with plans made for the wedding day or not following established protocols.

  • Damages caused to the venue or guests (e.g., from tripping).

  • Lack of public liability insurance.

  • Aging, accidents, or damages occurring after delivery of the artwork.

3. EXPECTATIONS FROM THE CLIENT

The Client agrees to:

  • Cover any additional travel costs if the Artist needs to move from the ceremony to the reception or for travel beyond 50 km.

  • Grant permission to the Artist to take photos and videos of references, guests, venue, background, settings, and other businesses' work.

  • Assume responsibility for any issues arising with businesses, venues, or guests regarding photos taken.

  • Communicate any protocols of the venue and other businesses prior to the event date.

  • Provide a space of at least 1m x 1m for the Artist's setup.

  • Communicate and establish social media boundaries in advance.

  • Align their expectations of the artwork style based on the Artist’s portfolio, recognizing that art is subjective.

  • Notify the Artist of any requested touch-ups within one week after the wedding; alterations will not be accepted after this period.

4. AGREEMENTS BY THE CLIENT

The Client agrees to the following:

  • The Artist may use a phone and camera at the reception and ceremony.

  • The Artist is covered for adverse weather conditions (e.g., rain, wind, extreme heat above 36 degrees Celsius) and may need to relocate to ensure the safety of materials and the Artist.

  • The painting will only include the couple being married; additional subjects or requests (including pets) will incur extra costs.

  • Costs for any damage to the Artist's materials due to guest accidents or venue accidents will be covered.

  • The Artist’s use of tools and assistive technologies in their artistic practice is accepted.

  • The term "live" refers to the Artist’s presence and not to traditional "painting from life."

  • Promotional sharing will prioritize authentic, honest, and branded content over couple-specific promotion, with content posted without the couple's consultation.

  • Promotion may extend to marketing discussions with guests, vendors, and the venue during the event.

  • The Artist will have artistic direction over choices, changes, and style.

  • Touch-ups to the painting will take between 2-6 weeks.

  • In the event of disputes arising from this Agreement, both parties agree to attempt mediation in good faith first. If unresolved, arbitration may follow in accordance with Australian laws.

  • Parking costs will be covered if not available.

  • Any modifications to this Agreement must be made in writing and signed by both parties to be valid.

  • The Client will own the final artwork upon full payment, while the Artist retains the right to use images of the artwork for promotional purposes, including social media and portfolio use.

AGREEMENT ACCEPTANCE

By checking the box on the google form, I (client) acknowledge that I have read and agree to the terms of this Service Agreement.
